Terms and Conditions

(1) Introduction

The Canadian Partnership for Women and Children's Health (CanWaCH) is collecting online videos through its website Women Deliver 2019 Mobilization Canada (hereafter “The Mobilization”) in order to showcase the importance of gender equality for the average Canadian. The ultimate objective is to demonstrate to decision makers that Canadians support gender equality and want to see real commitments made in support of gender equality. The “OUR STORIES” page of the website is designed to offer Canadians an opportunity to provide their input and to meaningfully engage with others through the innovative tool of video vignettes. The information collected through this video collection—upon approval by the moderator—will be available for public viewing on the website www.ourstories.wedeliver2019.ca. From time to time, certain videos will be featured on the social media platforms managed by The Mobilization. The Terms and Conditions set out for the use of The Mobilization website and the Privacy Notice describes how your personal information will be collected and for which purpose, as well as how it will be used and disclosed. The Terms and Conditions and the Privacy Notice should be read jointly.

(2) Mobilization Use and Reproduction of Materials

  1. Ownership and usage of content by The Mobilization

    Materials on The Mobilization website (www.ourstories.wedeliver2019.ca) were developed for the purpose of collecting online videos to showcase the Canadian public’s support for Gender Equality.

    By posting written or video comments on the site, you hereby grant The Mobilization a non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, translate, prepare derivative works of, display, and perform the user-generated content in connection with The Mobilization and third-parties under agreement with The Mobilization, including without limitation for promoting and redistributing part or all of the user-generated content in any media format and through any media channel, but for the sole purpose of promoting the objectives of The Mobilization.

    By posting a video onto the website, you hereby consent to the use and publication of your image. If another person is featured in the video, you must receive their consent (or the consent of their parent if they are a minor) prior to posting it on the website.

    The Mobilization reserves the right to use any user-generated content on the site for communications or any other purposes related to The Mobilization.

(3) Use and Reproduction of Materials by Third Parties

  1. Non-commercial reproduction

    Subject to Terms (3) and (4) below regarding commercial purposes, you (meaning any video commenter, viewer, or other user of the site) may reproduce the materials in whole or in part for non-commercial purposes, and in any format, without charge or further permission, provided you do the following:

    • Exercise due diligence in ensuring the accuracy of the materials reproduced;
    • Indicate both the complete title of the materials reproduced as well as the creator (where available); and
    • Indicate that the reproduction is a copy of the version available at www.ourstories.wedeliver2019.ca.
  2. Commercial Reproduction-Consent Required-Held by The Mobilization

    Unless otherwise specified, you may not reproduce materials on this site, in whole or in part, for the purposes of commercial redistribution without prior written permission from the copyright administrator. To obtain permission to reproduce The Mobilization materials on this site for commercial purposes, contact:

  3. Copyright Held by Another Party

    Some of the content on The Mobilization website (www.WeDeliver2019.ca) may be subject to the copyright of another party. Where information has been produced or The Mobilization does not hold copyright, the materials are protected under the Copyright Act, and international agreements.

  4. Trademark notice

    The official symbols of The Mobilization, including the Mobilization’s logo, may not be reproduced, whether for commercial or non-commercial purposes, without prior written authorization.

(4) Participation guidelines

  1. General guidelines

    The Mobilization wants all participants to provide open and honest opinions and stories to the public and decision makers while ensuring a respectful and productive online discussion.

    The Web is a 24/7 medium and your video submissions are welcome at any time. All videos will be subject to moderation before they are posted. The Mobilization may modify or edit your video submission to decrease length, for a better understanding or for technical reasons, but will strive to respect the content and meaning of your submission in doing so.

  2. Video guidelines

    All video submissions will be reviewed by The Mobilization and/or third-parties under agreement with The Mobilization before they are made accessible to the public. This moderation is a precautionary measure to ensure guidelines are followed but it does not limit your liability and responsibility.

    The Mobilization or third-parties under agreement with The Mobilization may modify or edit your submission to decrease its length, for a better understanding or for technical reasons, but will strive to respect the content and meaning of your submission in doing so.

    In using the video submission process, you shall not:

    • Copy any content unless expressly permitted to do so either herein or by the owner of the copied content;
    • Upload, post, email, transmit or otherwise make available any material that:
      • Is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially or ethnically objectionable, encourages criminal behavior, gives rise to civil liability, violates any law, or is otherwise objectionable;
      • You do not have a right to make available under any law or under a contractual relationship;
      • Infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party (including privacy rights);
      • Is or contains unsolicited or unauthorized advertising, solicitations for business, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
      • Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or data or the consultation website or that of any users or viewers of the consultation website or that compromises a user’s privacy; or
      • Contains any falsehoods or misrepresentations or create an impression that you know is incorrect, misleading, or deceptive, or any material that could damage or harm minors in any way;
      • Shows any individuals who have not consented to their inclusion in the video and its submission to the consultation website;
    • Impersonate any person or entity or misrepresent their affiliation with a person or entity;
    • Manipulate identifiers in order to disguise the origin of any material transmitted to or through The Mobilization website or impersonate another person or organization;
    • Interfere with or disrupt The Mobilization website or servers or networks connected to the consultation website, or disobey any requirements, procedures, policies or regulations of networks connected to The Mobilization website or probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures;
    • Intentionally or unintentionally violate any applicable local, state, provincial, national or international law or regulation;
    • Collect or store personal data about other users or viewers;
    • License, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the consultation website or applications associated with The Mobilization;
    • Modify, translate, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of any third-party applications associated with The Mobilization website or any software provided or used as part of The Mobilization website, except to the extent the foregoing restrictions are expressly prohibited by applicable law.

    The Mobilization reserves the right to remove any content submitted that violates any of the above guidelines or for any other reason at the Mobilization’s sole discretion.

Private Notice

(1) Introduction

To provide The Mobilization with a video or videos to be housed on the OUR STORIES page of the website, you must register on this site by creating an account which requires you to provide an e-mail address, first name and last name. All comments you post on the site will only display your first name and last initial (e.g. Jane D).

You may visit any part of this site without registering or providing any personal information.

(2) Your Privacy and the Internet

  • Third party components will only be accessed when they are needed, such as when sharing with URLs.
  • The Mobilization will only collect personal information and opinions if you supply it by email or if you register using the email sign-up process.

(3) Third-Party Social Media

The Mobilization’s use of social media is an extension of its presence on the Web. Social media account(s) are public and are hosted by third party service providers such as Facebook, Twitter and Instagram. Users who choose to interact with The Mobilization via social media should read the terms of service and privacy policies of these third-party service providers and those of any applications (apps) used to access them.
